1. Introduction
These Booking Terms (“Booking Terms”) apply when you book a class, event, membership, class pass, or other offering (“Booking”) through a booking page powered by the ATND ME platform (“Platform”), operated by ATND Limited of 1 Victoria Terrace, Churchtown Lower, Dundrum, Co. Dublin, D14 FA33, Republic of Ireland (“ATND ME”, “we”, “us”, or “our”).
When you make a Booking, two things happen:
(a) you enter into a contract with the business providing the class, event, membership, pass, or other offering (“Business”); and
(b) you pay a separate Platform Booking Fee to ATND ME for use of the booking and payment platform.
By completing a Booking, you agree to these Booking Terms.
2. Definitions
“Booking Amount” means the price charged by the Business for the relevant class, event, membership, pass, or other offering.
“Platform Booking Fee” means the separate fee charged by ATND ME for use of the booking and payment platform.
“Total Payment” means the Booking Amount plus the Platform Booking Fee, as shown before you complete payment.
3. Your Contract Is with the Business
The Business named on the booking page is the provider of the class, event, membership, pass, or other offering you are booking.
ATND ME provides the booking and payment platform only. We do not provide the underlying fitness, yoga, sauna, wellness, or other service being booked.
Questions about the service itself, including schedule changes, cancellations, refunds, and attendance, should be directed to the Business unless otherwise stated at checkout.
4. Pricing and Payment
Before you complete payment, you will see a breakdown showing:
(a) the Booking Amount charged by the Business;
(b) the Platform Booking Fee charged by ATND ME; and
(c) the Total Payment.
Payment is processed through Stripe. Your payment may appear as a single transaction showing both the Booking Amount and the Platform Booking Fee.
The Booking Amount is transferred to the Business through Stripe Connect. ATND ME retains the Platform Booking Fee.
You must provide accurate payment and contact information and ensure sufficient funds or credit are available.
5. Platform Booking Fee
The Platform Booking Fee is charged by ATND ME for providing the booking and payment platform that enables you to book and pay online.
The Platform Booking Fee is separate from the Booking Amount payable to the Business for the underlying service.
Where applicable, VAT is included in the Platform Booking Fee displayed at checkout or otherwise accounted for in accordance with applicable law.
6. Booking Confirmations and Receipts
After payment, you may receive a booking confirmation and/or receipt by email or through the Platform.
A receipt may show the Total Payment, including both the Booking Amount and the Platform Booking Fee.
The Platform Booking Fee shown on a receipt relates to services supplied by ATND ME. The Booking Amount relates to services supplied by the Business.
7. Cancellations, Changes, and Refunds
Cancellation, change, and refund rights for the underlying Booking are determined by the Business and any policy shown at checkout or on the booking page.
If you request a refund, the Business’s refund policy will apply to the Booking Amount unless otherwise required by law.
If a refund is issued for the Booking Amount, any Platform Booking Fee treatment will depend on the circumstances of the cancellation and applicable law. Where a full refund of the Total Payment is made, the Platform Booking Fee may also be refunded.
ATND ME does not guarantee refunds for Bookings made with a Business. Disputes about the underlying service should first be raised with the Business.
8. Your Responsibilities
You must provide accurate information when booking.
You must not misuse the Platform, attempt to circumvent payment flows, or use the booking system for unlawful or fraudulent purposes.
You are responsible for arriving on time and complying with the Business’s rules, policies, and reasonable instructions.
9. Liability
The Business is responsible for providing the booked service.
ATND ME is responsible for operating the booking and payment platform with reasonable care, but does not guarantee uninterrupted availability.
To the fullest extent permitted by law, ATND ME is not liable for the quality, safety, delivery, cancellation, or performance of the Business’s service.
Nothing in these Booking Terms excludes or limits liability that cannot be excluded or limited under applicable law, including statutory consumer rights.
10. Privacy
We process personal data in accordance with our Privacy Policy.
The Business may also process your personal data as a separate controller in connection with your Booking.
11. Governing Law
These Booking Terms are governed by the laws of Ireland, without prejudice to any mandatory consumer protection rights that may apply to you.
If you are a consumer, you may also have rights under applicable consumer protection law that cannot be excluded by these Booking Terms.
